Andres Fernandez De La Paz, 36, has been charged with murder in Harris County after he was seen on video shooting his ex-brother-in-law on Whittingham Lane over the weekend, according to KPRC News.
The victim, 34-year-old Ediesky Incencio Pineiro, was shot directly in front of his family in the chest and was pronounced dead at the hospital. "He was a wonderful person. I don’t have any bad memories of him. He was a good father and friend,” the wife of the victim, Raiza Cedeño Sosa, said.
Fernandez De La Paz used to be in a relationship with Cedeño Sosa's sister, however, she described the relationship as violent and toxic. Fernandez De La Paz has previously made death threats against the family. Fernandez De La Paz has also been under investigation for a credit card skimming scheme before the murder, according to three law enforcement sources who spoke to the outlet.
The suspect had been in the US illegally since 2016 and he was ordered to be deported in 2019. Despite the deportation order, "The Cuban government refused to accept his return at that time preventing ICE from carrying out his removal," a statement from ICE read.
ICE cannot hold those to be deported for longer than six months if their home countries do not accept them, and as a result, Fernandez De La Paz was released back into the US.
"Since that time, Fernandez has continued to remain in the US illegally and has been convicted of several criminal offenses including evading arrest and twice for credit or debit card abuse. Fernandez is also currently charged in Fort Bend County, Texas, with allegedly committing credit or debit card abuse for a third time. An immigration judge from the Justice Department’s Executive Office for Immigration Review ordered Fernandez removed to Cuba June 28, 2019, however, the Cuban government refused to accept his return at that time preventing ICE from carrying out his removal," the ICE statement added.
