Arturo Gamboa, 24, has been released from jail following the start of an investigation into the "peacekeeper" who actually fired the shots that killed Arthur “Afa” Ah Loo in Salt Lake City.
According to the Utah News Dispatch, a judge ordered that Gamboa, who was carrying an AR-15 style rifle at the Salt Lake City "No Kings" protest last Saturday, but did not shoot anyone, will be released from jail on conditions. He was originally going to be charged with murder, but that charge has not been finalized.
A so-called "peacekeeper" with the left-wing activist group Utah 50501 was the person who fired three shots at Gamboa, injuring him, but also killing innocent bystander Arthur “Afa” Ah Loo, who leaves behind a wife and child. The national 50501 organization has disowned the local Utah chapter of 50501. It is legal to open carry in Utah.
As of Friday, the Salt Lake County District Attorney, Sim Gill—who is linked to left-wing mega donor George Soros—has not filed charges against Gamboa or the "peacekeeper" in the incident. One of the men, whom the left-wing organization has said was volunteering as a "peacekeeper," told police following the incident that Gamboa had gone behind a wall to "manipulate" the AR-15 and was then charging the crowd with the gun in a "firing position." The “peacekeeper” has yet to be publicly identified.
However, video from the incident showed that Gamboa had the gun pointed down, and Gamboa's attorney has said that the rifle he was carrying at the event was not loaded.
“All of the evidence confirms that he was lawfully and openly carrying an unloaded firearm on a public road,” defense attorney Greg Skordas said. “He never brandished it, never fired it and never pointed it in the direction of anyone. He was shot in the back by a person who needlessly shot two innocent men, killing one.”
Skordas alleged in a petition that Gamboa was being “unlawfully detained in violation of his constitutional rights and governing procedural rules."
